    The year 2009 was a very significant year in the context of LGBT movement in India . In this year the Delhi High Court gave the historical order by reading down Section 377 of IPC thereby relieving homosexuality from being a criminal offence. But scope of section 377 is much wider which categorize carnal intercourse irrespective of sex and gender as an unnatural act and says that the persons indulging in carnal intercourse will be deemed to have committed a crime and will be victimized . But for a long period only the homosexual community were being targeted and abused or victimized under the section and same was not being imposed on any alike acts for example an carnal intercourse between a man and a woman.

    From this point of view the Delhi high court judgment was a milestone in LGBT movement in our country. But the order was subsequently challenged in the Supreme Court and after 21 months of anxious waiting came the verdict on the 11th of December 2013 which dismissed the order of Delhi High Court and reinstated the criminality of homosexuality in India.This order is totally against our constitutional fundamental rights of freedom and independence and the right to live with dignity and respect and without being discriminated.

    The order has not only exposed the LGBT movement to uncertainty but has exposed the entire LGBT community to being subject of violence and stigma.The order has also sent wrong signals about India to the outside world as our countrys biggest asset is its democracy. The order has itself defeated the entire essence of the word democracy.

    Association of transgender/Hijra in Bengal is the first registered network in India working with issues related to the transgendered people and hijra community as well. The network partners and associates have organized a protest rally on 21st of December 2013 to start from hazra crossing Kolkata at 3.00 pm and terminate in front of Academy of Fine Arts.The whole purpose of the rally is to communicate our protest to a larger forum and develop a strong public support in our favour which will be used as a valuable input to formulate our future strategies to challenge this order and get a space of respect in our society.

Its scope is vast: it allows anyone to refuse to provide “services, accommodations, advantages, facilities, goods, or privileges; counseling, adoption, foster care and other social services; or provide employment or employment benefits” to anyone suspected of being complicit in celebrating or enabling the commitment of any kind of a gay couple.
