    NEW DELHI: The government on Monday justified its decision not to include marital rape as a sexual offence in the Criminal Law Amendment Ordinance, 2013, saying that this could weaken the institution of marriage, but admitted that it was still grappling with the tricky issue of failed live-in relationships where an ex-partner is accused of rape committed under the false promise of marriage.
    At a meeting of the parliamentary standing committee on home affairs here on Monday, several MPs — mainly from Left parties and even ally DMK — sought clarifications from senior MHA officials on issues such as marital rape, "rape" in live-in relationships and amendments proposed to the Armed Forces Special Powers Act (AFSPA) by the Justice J S Verma Committee. Union home secretary R K Singh, in his reply to the panel headed by BJP leader M Venkaiah Naidu, clarified that marital rape was left out from the purview of the Ordinance as marriage presumes consent. He added that government decided against recognizing marital rape as this would go against the traditional family system in India where a marriage is seen as a steadfast institution. The official is said to have articulated the government's apprehensions that accusations of rape might be made in the wake of marital disputes, causing irreparable damage to the institution of marriage.
    Incidentally, DMK member Kanimozhi is learnt to have pitched for including marital rape as a sexual offence, arguing that presuming consent in a marital relationship was an archaic notion.
    Women's activists have been demanding recognition of marital rape, which is an offence in more than 100 countries. In its submission to the standing committee, All India Democratic Women's Association (AIDWA) had called exemption of marital rape flawed and unreasonable.
    The issue of sexual abuse in live-in relationships, which was not explicitly covered by the anti-rape Ordinance promulgated on February 3, was also raised by some MPs. The home secretary, while admitting scope for misuse as a person in a live-in arrangement could falsely accuse her partner of rape in the event of the relationship not culminating into marriage, said it was like a breach of promise (of marriage) based on which the person had entered into the live-in. Singh assured the members that the government was discussing how to address "rape" by a live-in partner.
    The Left was also critical of the government's failure to immediately accept Justice Verma's recommendation for amending AFSPA and the issue of prior sanction for prosecuting officers in uniform. The home secretary, however, sought to assure the members that armed forces personnel did not enjoy any immunity under AFSPA, and a rape accused had to face a military court of inquiry and was brought to justice. Some members, however, were not convinced.
    The standing committee's report is likely to be finalized on February 21 and submitted to Parliament in the first week of March.

    একে ধর্ষন ও খুনের অনুমতি ছাড়া কি বলা যায়?

    প্রথমেই লিখেছি কারুর মৃত্যুই কাম্য নয়। কিন্তু অপরাধী তার কৃতকর্মের কারনে আত্মহত্যা করলে সেটা আমার কাছে রিয়েলাইজেশনের অন্য রূপ। সেটাই শাস্তি।

  • কল্লোল-দার গতকালের কথায় তো ঘেঁটেই ছিলাম, আজকের পর আরো ঘেঁটে গেলাম।
    কল্লোল-দার কথা শুনে মনে হচ্ছে বর্তমান-এর সংশোধনাগারে ( কল্লোল-দা বা অনেকেই, হয়ত কিছুটা আমিও যে ধরনের সংসধানাগের এর কথা ভাবেন তার কথা হচ্ছে না) হাতের কাছে আত্মহত্যা করার বিভিন্ন ইন্স্ত্রুমেন্ত্স মজুত রাখা যেতেই পারে। নিদেনপক্ষে খাটনি করে অপরাধী-কে নজরে রাখার দরকার-ও নেই। অপরাধী অনুতপ্ত হলে স্যুইসাইড করার যাতে সুবন্দোবস্ত থাকে, সেটা খেয়াল রাখতে হবে। স্যুইসাইড করলে শাস্তি তো হয়েই গ্যালো।
    আমি নিশ্চিত, কল্লোল-দা এরকম মানে করেননি। কিন্তু আমি এরকমই বুঝলাম।

  • এরকম মানে দাঁড়ালে দুষ্টু লোকে বলবে যে এইটা হল উইন-উইন কেস। যারা ক্যাপিটাল পানিশমেন্টের বিরোধী তাদের কথামতন ডেথ পেনাল্টি তো দেওয়া হয়নি, অতএব উইন। আবার ইউকে-তে মিলি ডাইলারের ঘটনার পর একটা মত উঠে এসেছিলো যে পাবলিক মানি-তে এই ক্রিমিনালদের পোষা হবে কেন? তো অপরাধীরা সুইসাইড করে ফেললে তাদেরও উইন।

    The Delhi police have confirmed there was in fact a threat to kill the prime accused in the gang rape of the 23-year-old student. Several cell phone intercepts have revealed that there was a plot to kill Ram Singh while he was being taken to court, reports CNN IBN. Several phone calls were made inside Tihar jail from January, almost all plotting to kill not just Ram Singh, but the other four rape accused. . The police also said the Tihar jail officials were informed of the threat and commandos were placed used the court after the intercept. A report on CNN IBN says that Amit Shukla the murder accused in the Soumya Vishwanathan case was using a cell phone inside the jail and had made calls to several people.

  • আমি মনে করি একজনের জীবনের অধিকারের মত একজনের মৃত্যুর অধিকারও তারই। কেউ যদি মনে করে তার আর বেঁচে থাকার দরকার নেই তো সে নিজেকে শেষ করে দিতেই পারে। এটা তার মৌলিক অধিকার। আমাদের দেশে এবং আরও বহুদেশে এই অধিকার স্বীকৃত নয়।
    রাম সিংএর যদি মনে হয়ে থাকে সে যা করেছে তারপর তার বেঁচে থাকার অধিকার নেই, মানে নেই, তো সে আত্মহত্যা করতেই পারে। আত্মহত্যা করার সুবন্দোবস্তো রাখতে হয় না। যদি কেউ মরতে চায় তার উপায়ের অভাব হবে না।
    ব্যাসদেবের পুত্র শুকদেবের আত্মহুতির কথা স্মরণ করুন।

    এটা মৃত্যুদন্ড নয়। মৃত্যুদন্ড মানে যা রাষ্ট্র বা অন্য কোন এজেন্সি কার্যকর করে, যাকে দন্ডিত করা হচ্ছে তার ইচ্ছে নিরপেক্ষভাবে।
    জানি এরপর সেই অদ্ভুত যুক্তিটা আসবে। শেষ পর্যন্ত তো মরেই গেলো। আমার একটাই বলার - আমি কাউকে টাকা দিলাম, আর কেউ টাকা আমার থেকে কেড়ে নিলো, দুক্ষেত্রেই টাকা তো হস্তান্তরই হলো শেষ পর্যন্ত। তাতে কি দুটো ঘটনা এক হয়ে যায়?

    আপাতত অক্ষ-দাকে দুটো কথা বলে যাই, অক্ষদা ও কল্লোলদা দুজনের কাছেই অগ্রিম মাপ চেয়ে। ভুল হলে ধরিয়ে দেবেন।

    অক্ষদা, আমার মনে হয় কল্লোল-দা শাস্তি সম্বন্ধে ওঁর দর্শনটা বোঝাতে চাইছেন। টেকনিক্যাল ডিটেইল্স বাদ দিয়ে। ঠিক কী ভাবে লিখলে বোঝানো যাবে জানি না, যদি কোনো দিন কোনো কাস্টডিয়াল কিলিং (এমন কি এই কেসেও হতে পারে) এর আলেগেশন আসে, তাহলে কল্লোলদা প্রতিবাদ করবেন বলেই মনে করি।

  • আর জেলে রেপিস্টদের সবচেয়ে জঘন্য ভাবে ট্রিট করা হয়, সমস্ত বাকি বন্দীরা তাদের সবরকমের ক্ষোভ জ্বালা, অসুস্থতা এইজায়গায় উগরে দেয়, পুলিশ ইত্যাদির সামনেই ঘটে এসব। রাম সিংএর ক্ষেত্রেও তাই হয়েছিল। সেটাকে কী সাপোর্ট করি? যদি না করি, সেটা তো যথেষ্ট সুইসাইড ট্রিগার করার জন্য। তাইলে এত সব সংশোধন ইত্যাদির কথার অর্থ কী? ফাঁসির বিরোধিতা করলে এগুলো নিয়েও ভাবা দরকার।

    ‘Whose culpability: yet another custodial death in Tihar

    In the present context of recurring instances of deaths in custody in Tihar, it seems Right to life enshrined in Article 21 of the Indian Constitution has become an exclusive right that ceases to be a fundamental right, behind the closed doors of prisons. The alleged suicide of the Delhi gang rape accused Ram Singh in Tihar, reverberates the same approach of sheer disdain on the part of the jail authorities, towards the rights of the prisoners.

    In defending the right to life of the accused, PUDR in no way defends the crime for which he was incarcerated; however, the selective guarantee of the most basic of rights to citizens is unacceptable. While the issue of negligence on part of the custodians resulting in the alleged suicide takes prominence, PUDR also questions the empirical projection of his death as ‘suicide’. The facts that Ram Singh was not in a single cell, and there were three other inmates in the same cell who slept through the night while Ram Singh made all the preparations to hang himself, that one of his arms did not work and the ceiling of the cell was 8 feet high, evoke suspicion. Ram Singh had earlier complained of sodomy and torture including blade attacks. He was kept under 'suicide watch’ after ‘he had stopped talking and interacting in jail’. However, it is only after his death Tihar authorities have claimed that he had been removed from ‘suicide watch’.

    Ram Singh’s death adds up to the escalating figures of custodial death in Tihar numbering 18 in 2012. In 2013, there are reported 2 deaths in custody already. Early this month an inmate Santosh Kumar, a handicapped undertrial, died. The inquiry into the death has revealed serious lapses on the part of the jail authorities resulting in his death, the inmate lost 30 kg within a span of 15 months in prison, and died of an infection at the site of a surgically inserted feeding tube that started leaking in prison. Even in such cases where there are seemingly no evidences to suggest any foul play in the custodial death, it does not absolve the custodians of the responsibility of ensuring the right to life of the prison mates. Given these considerations, and the mounting figures of custodial death, even if Ram Singh’s death is accepted as a case of suicide, it still indicts the jail authorities of negligence and an approach of scorn towards the fundamental right to life, deserving strong condemnation.

  • অনুতাপে আত্মহত্যা করল, নাকি পালানোর আর পথ নেই বলে করল, নাকি অন্য বন্দীদের কাছে হিউমিলিয়েশনের কারণে করল - সেটা কিভাবে বোঝা যাবে? আর আত্মহত্যা করাকেই বা অনুতাপের পরাকাষ্ঠা হিসেবে ধরা হবে কেন? কল্লোলদাকে নিজের অবস্থানটা নিয়ে ভাবতে অনুরোধ করব। মানেটা এমন দাঁড়াচ্ছে যে আমাদের কল্পনার আদর্শ 'সংশোধনাগার' অপরাধীর এমন মানসিক 'অনুতাপ' উৎপাদন করবে যাতে সে আত্মহত্যা করে নিজেই নিজেকে কৃতকর্মের জন্য 'শাস্তি' দেয়। কল্লোলদা হয়তো এটা বলতে চাননি। কিন্তু রিঅ্যাকশনটাকে এক্সটেন্ড করলে এটাতে পৌঁছোনো যাচ্ছে। যেটা খুব একটা ঠিক লাগছে না।
