    The U.S. Department of Justice fired back with a serious accusation. It filed a civil complaint claiming that the company, by not handing over its files, was interfering "with the United States' sovereign interests" in national security.

    The legal clash represents a rare and significant test of an investigative tool strengthened by the USA Patriot Act, the counterterrorism law enacted after the attacks of Sept. 11, 2001.

    The case is shrouded in secrecy. The person at the company who received the government's request—known as a "national security letter," or NSL—is legally barred from acknowledging the case, or even the letter's existence, to almost anyone but company lawyers.

    This bill is a devastating attack on health services research funding.

    Among the many cuts to public health programs and policy riders, the bill “terminates” the Agency for Healthcare Research and Quality (Sec. 223), zeroing out its budget entirely. This is the first such attack on AHRQ funding in nearly two decades.

    AHRQ funds research and programs at local universities, hospitals, and health departments that improve health care quality, enhance consumer choice, advance patient safety, improve efficiency, reduce medical errors, and broaden access to essential services. It is a major funder for the work of our field. In a 2006 survey of AcademyHealth members, 42 percent of respondents reported receiving research support from AHRQ. Many, many more have expanded their skills and research capacity through AHRQ’s training programs and professional development opportunities.

    But AHRQ is not the only target. The bill also prohibits funding for patient-centered outcomes research (Sec. 217). This PCOR prohibition would extend to ANY federal agency in the subcommittee’s jurisdiction, including the National Institutes of Health (the Veterans Health Administration would not be subject to the provision, as their budget is in another subcommittee’s jurisdiction). NIH funding otherwise remains unchanged, but funding for CDC and SAMHSA are cut by 10 percent and 9 percent, respectively.....

  • The relentless, weather-gone-crazy type of heat that has blistered the United States and other parts of the world in recent years is so rare that it can't be anything but man-made global warming, says a new statistical analysis from a top government scientist.

    The research by a man often called the "godfather of global warming" says that the likelihood of such temperatures occurring from the 1950s through the 1980s was rarer than 1 in 300. Now, the odds are closer to 1 in 10, according to the study by NASA scientist James Hansen. He says that statistically what's happening is not random or normal, but pure and simple climate change.

    "This is not some scientific theory. We are now experiencing scientific fact," Hansen told The Associated Press in an interview.

    Hansen is a scientist at NASA's Goddard Institute for Space Studies in New York and a professor at Columbia University. He has called for government action to curb greenhouse gases for years.

    In a departure from most climate research, Hansen's study — based on statistics, not the more typical climate modeling — blames these three heat waves purely on global warming:

    —The 2003 European heat wave blamed for tens of thousands of deaths, especially among the elderly in France.

    The analysis was written before the current drought and record-breaking temperatures that have seared much of the United States this year. But Hansen believes this too is another prime example of global warming at its worst....

    The Daily Mail’s article noted the Electronic Privacy Information Center wrote a letter to the House Homeland Security Subcommittee on Counter-terrorism and Intelligence, describing it’s choice of words as ‘broad, vague and ambiguous’.

    What wasn’t disclosed is how the agency actually gains access to the various search engines and social networks to monitor the specified keywords. My guess is the DHS has a “special arrangement” with companies like Google, Facebook, Microsoft, Yahoo and Twitter to gain secure direct API access. This type of access would allow it to use distributed cloud technologies to monitor the daily flow of social media and search activity in something close to real time.

    I would love to learn more about the technologies used to accomplish this type of social / web monitoring. The applications for monitoring trends and social statics are fascinating when applied to other industry sectors. Given the extent of the monitoring, I’m sure this post itself is now coming up on the DHS radar, so please feel free to leave a comment with any insights.

    The Postal Service last month failed to pay $5.5 billion for its fiscal 2011 prepayment obligation, which originally was due in September 2011 but was deferred by Congress until Aug. 1. That was the first time it ever defaulted on a payment to the Treasury Department. The $5.6 billion due this week, on Sept. 30, represents this fiscal year’s obligation.

    Bryant was one of them, and he remembers one incident very clearly when a Predator drone was circling in a figure-eight pattern in the sky above Afghanistan, more than 10,000 kilometers (6,250 miles) away. There was a flat-roofed house made of mud, with a shed used to hold goats in the crosshairs, as Bryant recalls. When he received the order to fire, he pressed a button with his left hand and marked the roof with a laser. The pilot sitting next to him pressed the trigger on a joystick, causing the drone to launch a Hellfire missile. There were 16 seconds left until impact.

    "These moments are like in slow motion," he says today. Images taken with an infrared camera attached to the drone appeared on his monitor, transmitted by satellite, with a two-to-five-second time delay.

    With seven seconds left to go, there was no one to be seen on the ground. Bryant could still have diverted the missile at that point. Then it was down to three seconds. Bryant felt as if he had to count each individual pixel on the monitor. Suddenly a child walked around the corner, he says.

    Second zero was the moment in which Bryant's digital world collided with the real one in a village between Baghlan and Mazar-e-Sharif.

    Bryant saw a flash on the screen: the explosion. Parts of the building collapsed. The child had disappeared. Bryant had a sick feeling in his stomach.

    "Did we just kill a kid?" he asked the man sitting next to him.

    "Yeah, I guess that was a kid," the pilot replied.

    "Was that a kid?" they wrote into a chat window on the monitor.

    Then, someone they didn't know answered, someone sitting in a military command center somewhere in the world who had observed their attack. "No. That was a dog," the person wrote.

    They reviewed the scene on video. A dog on two legs?
